Introduction

Ethics & Professional Responsibility law controls and/or guides attorneys and judges conduct. Most states look to either the American Bar Association’s Model Rules or the Code of Professional Responsibility and in whole or in part adopt their own rules for their judges and attorneys.

 

Legislation and Case law

Ohio Supreme Court Web Site   In Ohio, the place of last resort for appealing adverse disciplinary situations (among others) is the Supreme Court.  They direct and oversee the Board of Commissioners on Grievances & Discipline.

Task Force on Rules of Professional Conduct  This is the Ohio Supreme Court's Committee that is charged with revising Ohio's Rules of Professional Conduct.

Board of Commissioners on Grievances & Discipline Web Site   The Board of Commissioners on Grievances and Discipline of the Ohio Supreme Court consists of 28 members who are appointed to 3 year terms by the Court. The members consist of 17 attorneys, 7 active or retired judges and 4 non-attorney members.  The Board conducts hearings, preserves the record, makes findings and recommendations to the Supreme Court in disciplinary cases involving ethical misconduct charges brought against Ohio attorneys and judges. These cases include formal charges of misconduct alleged to have been committed by a judge, an attorney, a person under suspension from the practice of law or currently on probation. The Board also hears cases concerning the mental illness of any judge or attorney and hears petitions for reinstatement to the practice of law filed by suspended attorneys.  The Board issues nonbinding advisory opinions on ethical questions.  The Board is the appropriate ethics agency for receiving Financial Disclosure Statements filed annually by judges, judicial candidates and other judicial officers.

Ohio Ethics Commission Web Site   Another Ohio source for ethics information, the Ohio Ethics Commission promotes ethics in public service to strengthen the public's confidence that Government business is conducted with impartiality and integrity.  The Commission has jurisdiction over Ohio's public officials and employees at the state and local levels of government, except legislators, judges, and their staffs.  The Commission issues Advisory Opinions and has since 1974.  For the online version of past opinions, see Advisory Opinions Web Site

Ohio State Bar Association Website (Most of this topic material requires membership)  The Ohio State Bar Association, founded in 1880, is a voluntary professional association open to any person who has been admitted to the practice of law. Law school students are eligible for free membership in the OSBA as associate members. For information regarding Attorney Discipline click here.

American Bar Association Website (Most of this topic material requires membership)  The largest voluntary professional association in the world, the ABA provides law school accreditation, continuing legal education, information about the law, programs to assist lawyers and judges in their work, and initiatives to improve the legal system for the public.  The ABA offers student memberships for $20 annual dues.  Membership includes many helpful benefits. Cuyahoga County Bar Association  Members of the Cuyahoga County Bar Association are attorneys, judges, law students, paralegals, employees of government agencies, and other legal professionals working in Cuyahoga County, Ohio and the surrounding regions. Cleveland Bar Association   The mission of the Cleveland Bar Association is to serve as a center for legal professionalism in the region by educating the bar, by providing resources that enhance client service, and by promoting integrity and ethical behavior among lawyers; to improve the administration of justice on behalf of the public and the Cleveland legal community; to improve public understanding of the law and the justice system; and to foster an environment in which a diverse Association membership can experience excellence and fulfillment in the practice of law and service to the public.
