This selective guide highlights major print and electronic resources available to Cleveland State University students researching issues in Education Law.

Although some of the links below lead to Westlaw and LexisNexis database resources and require a valid law student Westlaw or LexisNexis password for access, many others link to LexisNexis Academic, an OhioLink research database, available to all C.S.U. students, faculty, and staff, who can access it on campus, or elsewhere via authentication. Some journals available electronically, such as those via HeinOnline, are only available on the C.S.U. campus or C.S.U. network.

Introduction

This guide is specifically designed to assist Cleveland State University students taking Education or School Law courses,  including Special Education Law, whether in the Cleveland-Marshall College of Law, or graduate/undergraduate courses in the College of Education.

Because legal issues related to education may involve any of a number of areas of law and legal research ( torts, constitutional law, etc.) the researcher is encouraged to start with a secondary source - book, article, ALR, etc., and then follow annotations to statutory law and court decisions.

Legislation

Ohio:

The Ohio Revised Code's Title 33 contains the laws passed by the Ohio General Assembly relating to Education matters, however there may be other sections of the Code more pertinent for a topic: 

For example -

the definition of an "athletic trainer" is in the ORC volume

Title 47 Occupations -- Professions, in § 4755.60

"Persons required to report injury or neglect" is in

Title 21 Courts -- Probate and Juvenile, in §2151.421

"Protection orders concerning domester violence" in

Title 31 Domestic Relations - Children, in §3113.31

Start with the Index to the ORC, and then go to the Title and section.

Note in nearby sections if there are definitions related to the code provisions. 

In an annotated code, both the language of the law as presented in the Code section, and the annotations following it, can facilitate your research. Annotations include citations to cases that the editor believes are related to the code section, cross references to other code sections, and perhaps history sections indicating information about amendments to the code section. Annotations also often include references to other books, practice manuals, and legal periodical articles which discuss the statute.

Also check the pocket part supplement when using print codes for any amendments to the section and/or more recent annotations to court decisions.

The Law Library has a current print annotated code for many states. The sets are shelved by call number, alphabetically by state, on the Atrium Level of the Law Library, beginning with KFA (Alabama, Alaska, Arizona), KFC (California), etc. Code arrangement will vary by state.

Start with the index, and check the pocket part supplement for amendments to the law and newer annotations to court decisions.

Both publishers' print codes include a multi-volume subject index. Once you identify a specific article, you can print the pdf version of a page or the entire article. Generally the footnotes will be at the bottom of each page. Also, charts (if any) will be available in this format whereas they are likely not to be in some of the other databases. 

To print an article in Hein Online, at the top right of the article screen, click on Print/Download Options. Then select the pdf for Current section, if you want to print the entire article, or Current page pdf to print just the single page. (If you do not take the step of the Print/Download Options screen, and just print screens, the bottom few lines of each page are likely to appear on a second page - not what you want for a long article.)

Journal titles available in print format have the call number, and location/availability information, indicated in the Law Library Scholar record.

Older volumes are shelved by call number, generally on the Base Level, beginning at K1.

Selected News/Magazine/Other Databases (not for "law journal" articles):

 

News articles, whether from direct electronic sources or via LexisNexis Academic , LexisNexis, Westlaw, ProQuest, etc., or from print newspapers or newsletters, can frequently give clues to facilitate your research on legal issues - names of parties in court cases, date of decision, which court, judge's name, some words or phrases which may be useful for a full-text search, etc..

For comprehensive coverage of national level issues:

In Step One: Select the news category, General News , and in

Step Two: Select a news source  - Major Papers to search full text of the New York Times, Washington Post, and many others.

For Ohio articles:

In Step One: Select: U.S. , and in Step Two, Ohio

For international articles:

In Step One: select: World News , and in Step Two: select a region.

Use date qualifiers in Step Four that aren't too great a time span.

Search using the same techniques as in the Legal databases.
