Introduction

Environmental Law generally addresses the interactions of federal, state, and local laws and regulations - as well as the application of these laws and regulations to case studies - concerning ecological systems.  Key concerns include air pollution, water pollution, hazardous waste, toxic substances, conservation, and cultural/historical preservation.

Environmental issues gained particular attention in the 1970s.  Since the 1990s, there has been increased criminal enforcement of federal environmental programs in the United States and, because of the recognition of potential harm to shared resources, more international cooperation.  Environmental Law may be viewed in terms of "cooperative federalism," in which federal, state, and local governments respond to environmental issues.  There are federal incentives to state and local activities, as well as state and local enforcement of federal programs. One problem area is the potential for conflicting statutory requirements, because multiple federal agencies administer federal programs.  In addition, due to the "threat of terrorism," federal agencies may currently limit access to, or the content of, environment-related government information such as that concerning the energy infrastructure.

Environmental Law has relationships to Land Use Law, Natural Resources Law, and Energy Law.  To fully understand and appreciate the myriad issues in these fields, one may need to conduct interdisciplinary research in biology, physical science, social science, economics, history, and other areas.  When researching in the life, physical, and social sciences, remember that current knowledge in these disciplines is primarily found in the journal literature, and one should never simply rely upon books.  Also, note that Land Use Law has historically been considered part of the "reserved police power" of states, and states usually delegate that power to Local governments.

Regulations and Rules

National Environmental Policy Act (NEPA) requirements are imposed on all federal agencies engaged in activities significantly impacting the environment.  Perhaps most important is the requirement for an "environmental impact statement."  Federal agency environmental impact statements are given to the Council on Environmental Quality (CEQ), Congress, and "public"; their publication is announced in the Federal Register.  Environmental impact statements may be obtained directly from federal agencies.  There is no archive of all environmental impact statements.

Since 1985, Cambridge Scientific Abstracts has published EIS:   Digests of Environmental Impact Statements.  This publication is update bimonthly and has a topical arrangement (eg, air transportation, urban and social programs, water).  [This was previously published by Information Resources Press.]

Environmental Protection Agency
The EPA was created by the Reorganization Plan No. 3 of 1970 , which was based upon regulatory authority from NEPA and the Ash Council Memo that specified recommendations of the President’s Advisory Council on Executive Organization. The EPA is required by the Clean Air Act to review federal agency environmental impact statements.  EPA’s Web-based Laws, Regulations & Dockets includes EPA Docket (EDOCKET), regulations, proposed rules, statutes, and pending legislation.  EPA’s Web-based Information Sources includes document clearinghouses, federal agency activity dockets, publications, databases, and software.

Council of Environmental Quality (CEQ)
The CEQ was created by the NEPA, and is required by NEPA to issue environmental quality annual reports.  The CEQ issues "NEPA-implementation" regulations binding on all involved federal agencies (see 40 CFR Chapter 5).  Each involved federal agency issues "NEPA-implementation according to CEQ" regulations.
