Journal of Law and Health Symposium: The Legal and Ethical Implications of Posthumous Reproduction

The selection of the Symposium topic was a result of the recent Supreme Court decision in Astrue v. Capato, 132 S. Ct. 995 (2012). In that case, the Supreme Court held that children conceived through in vitro fertilization after the death of a parent were not automatically entitled to survivor benefits under the Social Security law. The Court stated that the children’s eligibility to receive the benefits depended upon their ability to inheritance under the state’s intestacy system.
