Hello, and welcome to Civil Procedure! Our required text is Friedenthal, Miller, Sexton, and Hershkoff’s Civil Procedure: Cases and Materials, Compact Edition for Shorter Courses, Twelfth Edition. 

 

Despite being “compact,” this casebook is not much less expensive than the standard-length text. As such, if you find an Eleventh Edition or a used non-compact book, that book should be sufficient for this class. However, keep in mind that the Eleventh Edition will be missing a few key cases, and that the page numbers in any alternative book will be substantially different.

 

I have not assigned the 2021–22 Supplement to the Cases and Materials book because it is mostly rules, statutes, and forms that are easily available to you through other means. For particularly relevant rules and the few cases found in the Supplement, I will provide you with either advance excerpts or relevant citations. 

 

Please complete the following reading assignment for the first class on Tuesday, August 24. This is a longer assignment than normal, so if you are short on time, I'd recommend that you focus on case comprehension rather than making sure you've skimmed every last portion. 

 

-Closely read Federal Rule of Civil Procedure 1. (It’s short.) 

-Skim all of Chapter 1 (pp. 1–37), but closely read the two short cases, Capron v. Van Noorden and Tickle v. Barton.

-SKIP Pennoyer v. Neff and closely read International Shoe Co. v. Washington (pp. 52–58).

-AFTER reading International Shoe, read the notes regarding Kane v. New Jersey and Hess v. Pawloski that precede International Shoe (pp. 48–52), along with Ohio Rev. Code Ann. § 2307.382 and R.I. Gen. Laws Ann. § 9-5-33(a).

-Read the notes regarding McGee v. Int’l Life Ins. Co. and Hanson v. Denckla that follow International Shoe (pp. 59–63).
