Behavioral Telehealth: Clinical And Legal Considerations For Mental Health Providers In The Age of Virtual Therapy is a 3-hour CE course that will cover the rapidly shifting trends in telehealth and will be facilitated by mental health and legal experts. Course CE approvals have been submitted for the Ohio Supreme Court, Ohio CSWMFT, & OPA.
Course Summary: An article published in the American Journal of Medical Quality by Maese et al. (2020) noted that “The COVID-19 pandemic has pushed telehealth to the forefront in a way that 30 years of physician advocacy could not. The pandemic forced the alignment of the policy, technology, and economics of telemedicine.” These changes also created a revolution in the delivery of behavioral health services with the rapid growth of providers offering virtual therapy to millions of Americans. The expedited changes left many legal professionals, law makers, and mental health professionals playing catch-up to understand the shifting landscape of legal and ethical considerations surrounding virtual therapy. This course will explore these considerations and discuss populations who may be disadvantaged by the rapid transition due to the digital divide.

Dr. Laura C. Hoffman
Dr. Laura C. Hoffman is an Assistant Professor of Law at Cleveland State University College of Law where she also serves as Co-Director for the Center for Health Law and Policy. Prior to this, Dr. Hoffman served as a Senior Research Fellow with the Solomon Center for Health Law and Policy at Yale Law School where she contributed to the development of projects and events involving palliative care policy, Elder Law, brain injury, and Disability Law. Additionally, she worked as an Assistant Professor of Law/Faculty Researcher for Seton Hall University School of Law’s Center for Health and Pharmaceutical Law and Policy where her work focused on research projects aimed at making policy changes to improve healthcare access for people with disabilities and children. Previously, Dr. Hoffman worked for Data Federal Corporation as a contract Attorney Advisor for the U.S. Department of Health and Human Services Office of Medicare Hearings and Appeals in the Cleveland, Ohio field office. She drafted appellate decisions for Administrative Law Judges involving legal disputes over Medicare payments. Dr. Hoffman earned her S.J.D. in Health Law and Policy from Loyola University Chicago School of Law in 2012. Additionally, she holds a LL.M. in Child and Family Law also from Loyola and a second LL.M. in Law and Government from American University Washington College of Law. Dr. Hoffman earned her J.D. from Ave Maria School of Law in 2007. Graduating cum laude and a distinguished graduate of the Class of 2004, she earned a B.A. in Political Science from the University of Notre Dame. Dr. Hoffman’s legal scholarship has been published in numerous law reviews and journals including the Notre Dame Journal on Legislation, the Pittsburgh Journal of Environmental and Public Health Law, the Iowa Journal of Gender, Race, & Justice, and the American Journal of Law and Medicine. Her legal scholarship has been cited by the National Council on Disability and the RAND Corporation. Dr. Hoffman is an Inaugural Fellow for the ASLME 2022-23 Expanding Perspectives Fellowship Program.
Bradley D. Reed, J.D.
Bradley D. Reed is a Partner at Frantz Ward LLP in Cleveland, Ohio where he specializes in healthcare compliance issues at the intersection of healthcare and technology. Brad works on a wide range of corporate, transactional, regulatory, data privacy/cybersecurity and employee benefits matters. Specifically, his practice focuses on working with hospitals, physicians, and other health care providers regarding complex regulatory and compliance issues. Brad regularly advises clients with respect to HIPAA compliance, Medicare and Medicaid reimbursement, health care fraud and abuse regulations, and medical staff management issues. He alsoworks on a wide range of various data privacy and cybersecurity issues, financial services regulations, ERISA compliance, service provider and vendor agreement negotiations, and other commercial contracts for clients in numerous industries and sectors. Additionally, he has experience handling ERISA, general litigation and intellectual property matters. He assists in investigating data security incidents and advises clients with respect to data breach reporting, mitigation and responses. He regularly prepares breach risk assessments and notifications under HIPAA and various state data breach notification laws.
Brad is driven by helping clients achieve their business needs and goals by assisting them to understand and navigate an increasingly complex regulatory environment. With new rules and regulations comes an opportunity for clients to implement creative and innovative solutions to meet their regulatory and compliance obligations. Brad ensures clients understand and achieve these solutions to help avoid future litigation or enforcement actions.
Stacy Simera, MSSA, LISW-S
Stacy Simera, MSSA, LISW-S, is an independently licensed social worker in Ohio. She provides counseling at Kent Psychological Associates, facilitates psycho-educational programming at the Oak Clinic for Multiple Sclerosis, and conducts trainings across the state for the Ohio Child Welfare Training Program. Ms. Simera also serves as chair of the sleep committee for the Ohio Adolescent Health Partnership and as the health policy director for the Ohio chapter of the national nonprofit Start School Later. Stacy has received several awards for her professional and community service, including Social Worker of the Year and Outstanding Service Award from the National Association of Social Workers Ohio Chapter.
